No charges were filed against a man who used his .40-cal. firearm to shoot two pitbulls attacking his dog in the backyard of his Tipp City, Ohio, home.

According to police, just after 1 p.m. on Feb. 10, the man opened his back door to let his dog out into his yard. Two adult pitbulls, one male and one female, wandered onto the property and attacked the owner's dog. The man yelled at the dogs in an attempt to stop the attack, but when the dogs became more aggressive, he fired, killing both animals.

So far, the owner of the pitbulls has not been located. Police indicated that the man took the right actions during the attack. "Given the circumstances, we feel that the property owner was well within his rights and acted legally," Miami County Sheriff's Office Chief Deputy Stephen Lord told reporters. W.A. Hanvey and his wife were closing their Anniston, Ala., store for the night when two men walked in. One shouted, "Hold it, this is it!" and raised a rifle.
