Connecticut Court Finds in Favor of Shooting Range

The Connecticut Superior Court found in favor of Blue Trail Shooting Range, ending the drawn-out court battle brought against the range by a neighbor.

7/19/2011

The Connecticut Superior Court has found in favor of Blue Trail Shooting Range, ending months of litigation and closing five different counts brought against the range by a neighbor, including private nuisance, intentional infliction of emotional distress, trespass and violation of the Connecticut Environmental Protection Act.

Judge Miller said in the decision that "the critical issue in this case is whether or not the lead found on the plantiff's property and the other areas in question came from bullets fired from the Blue Trail Range. The plantiff has failed to meet his burden of proof in this case."

Blue Trail Range closed at one point during proceedings, due to the financial constraints placed on it by the ongoing cost of the lawsuit. Eventually, the range re-opened and established the Save Blue Trail Range website in an effort to gain attention for its defense.

Attorney Martha A. Dean of Fishbein Law Firm, LLC who defended Blue Range and proprieter David Lyman said "Blue Trail Range is finally free of the dark cloud cast over it by uninformed and negative publicity and duplicative lawsuits."

This bodes well for all law abiding shooters in Connecticut. Kepp the faith and if you are not a member of the NRA what are you waiting for?
